Terms of Use
Welcome to the Wireless Internet Access using WLAN technology provided
by YGC. Before you enter The WIA, or use any YGC Service, please
read carefully the Terms of use set forth below (hereinafter - "Terms").
By using The WIA, you accept these Terms and agree to be legally
bound and subject to them. If you do not agree to the Terms please
exit The WIA immediately.
General Terms of Use
YGC may change the Terms from time to time and at any time and without
actual notice to you. In addition, YGC, at its sole discretion,
may change or cancel The WIA or any part thereof, and without any
actual notice to you. YGC does not guarantee to update The WIA and/or
its information and/or its related information.
WIA is provided to you by YGC on an "AS IS"
basis, for your private personal use only while in our Parent waiting/viewing
area. Use of WIA outside of our facility/gym is not allowed. Doing
so will be in direct violation of our WIA terms of Use. No claim
and/or demand and/or suit will arise out of the use of The WIA against
YGC and/or its workers and/or representative. Although, YGC has
tried to be as accurate and current as possible in order to keep
The WIA effective and safe, YGC does not guarantee reliability,
accuracy, or completeness of The WIA. YGC specifically disclaims
any warranties and liability, express or implied, concerning the
use of The WIA.
Limitation of liability
YGC assumes no responsibility, and shall not be liable for any kind
of damages to you and/or any third party related to you or anyone
on your behalf in connection with your use of The WIA including
damages that may occur to your computer and/or any equipment thereon,
including damages arising out of your use of any internet site or
other material via links from the site or from downloading files
from the internet.
Without derogating from the aforementioned, it is hereby made clear
that the access line to the internet and the modem itself, through
which the navigating in the net by WIA is possible, are not provided
by YGC and are not under the responsibility of YGC or whoever on
its behalf. YGC assumes no responsibility, and shall not be liable
for any kind of damages to you and/or any third party related to
you on account of errors, failures, omissions, or other inaccuracies
in the access line to the internet and the modem.
YGC is not responsible, and will not bear any liability, to The
WIA user and/or any third party in connection with the contents
advertised on the internet which may offend in some respect the
user and/or anyone on his behalf and/or any third party and which
contents may constitute a violation of any law and/or regulation.
YGC is not liable, and will not be liable, to The WIA user and/or
any third party, for loss of information and/or presentation of
information and/or disclosure of information of the user and/or
any third party, arising in any way out of the use of service.
For the purpose of this chapter, YGC shall be construed so as to
include its workers and representatives.
Acceptable Use Policy (hereinafter-AUG)
All
users of The WIA and users of this Web site agree to and must comply
with this Acceptable Use Policy (AUP). This AUP is intended to improve
the use of the Internet by preventing unacceptable uses. We do not
actively monitor the use of the WIA under normal circumstances.
Similarly we do not exercise editorial control or review over the
content of any Web site, electronic mail transmission, newsgroup,
or other material created or accessible over or through The WIA.
However, we may remove, block, filter, or restrict by any other
means any materials that, in our sole discretion, may be illegal,
may subject YGC to liability or may violate this AUP. YGC may cooperate
with legal authorities and/or third parties in the investigation
of any suspected or alleged crime or civil wrong. Violation of this
AUP may result in the suspension or termination of either access
to The WIA and/or your YGC account/membership/ registration or other
actions as detailed below.
1. Not to do any act which will be in violation of the AUP and
to follow the AUP
in full.
2. Any personal information provided by you while using The WIA
shall be
true,accurate, current and complete.
3. Not to impersonate any other person or entity or falsely state
or otherwise
misrepresent your affiliation with any other person or entity; forge
headers or
otherwise manipulate identifiers in order to disguise the origin
of any material
transmitted while using The WIA and/or through the process of registration
to The WIA and you will not do any act that is not allowed or authorized.
4. Not to do any act in violation of any applicable local, state,
national or
international laws, rules or regulations.
5. Not to present and/or add to The WIA and/or any other internet
site
information and/or contents and/or links that are unlawful and/or
might be
threatening, abusive,harassing to the public and/or might be tortuous,
defamatory, obscene, libelous, invasive of another's privacy and/or
might
encourage or abet the commission of an act that constitutes a felony
or
misdemeanor.
6. Not to edit and/or transmit to The WIA and/or via The WIA, a
linkage to
any computer software any material (by uploading, email, posting,
or otherwise)
that contains software viruses or any other computer code, files
or programs
whatsoever designated to interrupt, destroy or limit the functionality
of any
computer software or hardware or telecommunications equipment.
7. Not to use computer programs, computer files, internet sites
and other
services that require payment of fee, without paying the required
fee, through
The WIA.
8. That YGC will not be liable for any direct, indirect, or consequential
loss to
you or any one on your behalf or any third party rising from the
use of The
Service.
9. That the use of The WIA including any reliance on The WIA is
entirely at
your own risk.
10. That you are aware of the risks involved in using The WIA by
The WIA
user and/or any third party, including damages to privacy and/or
confidentiality
and/or safety of information .Therefore,the use of The WIA including
any
reliance on The WIA is entirely at your own responsibility, and
you hereby
release YGC of liability for any kind of damages, loss and/or material
loss,
directly, indirectly or consequential, that will be caused to you
or any one on
your behalf or any third party as a result of using The WIA.
11. To compensate and/or indemnify YGC and/or anyone on its behalf
for
any kind of damages including loss of profit and/or loss and/or
expenses,
including litigation costs and attorney's fees that will be caused
to YGC as
a result of breaching the AUP. YGC keeps its right to defend any
action
that will be taken against it for misconducts in connection with
the use of The
WIA and you are hereby undertaking to co-operate with YGC in such
actions as far as you will be required.
